By accessing and using 3DPlaySensation, a service operated by Akiva Litinsky ("Service", "we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service.
2. Description of Service
3DPlaySensation provides a web-based platform for:
- 3D model viewing and manipulation
- AI-powered image enhancement and generation
- AI-powered video generation
- AI material assignment for 3D models
- AI Artist Advisor for creative visual recommendations
- AI Mechanical Engineer Advisor for manufacturing and design consultation
- Virtual reality (VR) experiences
3. Account Registration
To access certain features, you must create an account. You agree to:
- Provide accurate, current, and complete information
- Maintain the security of your password
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized use
4. Subscription Plans and Credits
Our Service operates on a credit-based system with the following tiers:
- Free Trial: 60 credits (1 AI Image, valid for 7 days, one-time per email)
- Starter: $19/month or $194/year (15% off) - 1,500 credits/month
- Professional: $59/month or $599/year (15% off) - 4,500 credits/month
- Ultimate: $149/month or $1,519/year (15% off) - 12,000 credits/month
Credits are used for AI-powered features and reset monthly. Unused credits do not roll over to the next billing period. Free trial is limited to one per user/email address. Annual plans are billed upfront for the full year.
Unlimited Features (No Credits Required)
All subscription plans include unlimited access to these core features without using any credits:
- Import and view 3D CAD models with materials and animations
- Real-time material and environment customization with instant high-quality rendering
- Built-in exploded views and animations from your CAD files
- Create professional booklets and presentations
- Full VR experience with the same stunning quality as desktop view
- Interactive VR tools (screwdriver for collision detection, flashlight, caliper, and more)
- Change materials live while in VR mode
- Capture and save images directly from VR mode
- Unlimited screenshots and video recordings of your 3D models
Credit Boosts (One-Time Purchases)
Users may purchase additional credits as one-time boosts:
- Small Boost: 500 credits for $15
- Medium Boost: 1,500 credits for $39
- Large Boost: 3,000 credits for $69
Credit boosts are added to your current balance and do not expire as long as your account remains active.
AI Feature Credit Costs
The following AI-powered features consume credits:
- AI Product Images: 40-70 credits per image
- AI Marketing Videos: 360-1,600 credits per video
- AI Smart Materials: 60 credits per use
- AR Library Save: 100 credits per model
- AI Artist Advisor: 20 credits per conversation
- AI Mechanical Engineer Advisor: 40 credits per conversation
- Image to 3D (Ultimate tier only): 500 credits per 3D model generation
5. Payment Terms
- All paid subscriptions are billed in advance on a monthly or annual basis
- Annual subscriptions receive a 15% discount and are billed for the full year upfront
- Prices are in USD and exclude applicable taxes
- You authorize us to charge your payment method automatically
- Price changes will be notified 30 days in advance
5.1 Taxes and Fees
All payments are processed by Paddle.com, our Merchant of Record for all transactions. Paddle handles:
- Tax Collection: VAT, GST, sales tax, and other applicable taxes are calculated and collected automatically based on your location
- Tax Compliance: Paddle remits collected taxes to the appropriate tax authorities on your behalf
- Invoicing: Tax-compliant invoices are provided for all purchases
The final price shown at checkout will include all applicable taxes for your region. Tax rates vary by country and may include:
- EU countries: VAT at local rates (typically 19-27%)
- UK: 20% VAT
- Australia: 10% GST
- Canada: GST/HST/PST as applicable
- Other regions: Local taxes as required by law
For questions about taxes or to request a tax invoice, please contact support or access your invoice through the Paddle customer portal.
6. Acceptable Use
You agree NOT to:
- Use the Service for any illegal purpose
- Generate content that is harmful, abusive, or violates others' rights
- Attempt to gain unauthorized access to our systems
- Reverse engineer or copy our AI models or algorithms
- Resell or redistribute generated content for commercial purposes without permission
- Use automated systems to access the Service excessively
7. Intellectual Property
Your Content: You retain ownership of 3D models and images you upload. By uploading, you grant us a license to process your content to provide the Service.
Generated Content: AI-generated images and videos created through our Service may be used by you for personal and commercial purposes, subject to our Acceptable Use policy.
Our Service: The Service, including its software, design, and AI models, is owned by 3DPlaySensation and protected by intellectual property laws.
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We do not guarantee that:
- The Service will be uninterrupted or error-free
- AI-generated content will meet your specific requirements
- Results will be accurate or reliable
AI Advisor Services Disclaimer
AI Artist Advisor and AI Mechanical Engineer Advisor are automated AI systems that provide suggestions and recommendations for informational purposes only. These services do not constitute professional advice and should not be relied upon as such. Users acknowledge and agree that:
- All AI-generated responses may contain errors, inaccuracies, or incomplete information
- The user assumes full responsibility for independently verifying, validating, and confirming all AI suggestions before any implementation or use
- AI Mechanical Engineer advice does not replace consultation with licensed, qualified professional engineers
- Engineering recommendations must be reviewed and approved by appropriately credentialed professionals before use in any design, manufacturing, or production context
- 3DPlaySensation makes no warranty regarding the accuracy, completeness, reliability, or suitability of AI advice for any specific purpose
- The user waives any claims against 3DPlaySensation arising from reliance on AI-generated recommendations
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, 3DPlaySensation SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.
Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.
10. Termination
We may suspend or terminate your account if you violate these Terms. You may cancel your subscription at any time through your account settings. Upon cancellation:
- You retain access until the end of your billing period
- No refunds are provided for partial months
- Your data may be deleted after 30 days
11. Changes to Terms
We may update these Terms periodically. Continued use of the Service after changes constitutes acceptance of the new Terms. Material changes will be notified via email or in-app notification.
12. Governing Law
These Terms are governed by the laws of the State of Israel, without regard to conflict of law principles.
